Terms and Conditions

These Terms and Conditions (“Terms”) are a legally binding agreement between you (“you”, “User”) and  (“MadeInPK”, “we”, “us”), governing your use of the MadeInPK mobile application and the website made-in-pk.com (together, the “Platform”).

By creating an account, accepting the in-app Terms prompt, or using the Platform in any way, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy. If you do not agree, you must not use the Platform.

1. What MadeInPK is — and what it is not

MadeInPK is an online B2B marketplace that helps verified Pakistani businesses discover each other, list products, negotiate and record trade transactions.

MadeInPK is a neutral venue and technology provider. We are NOT:

  • a party to any sale, purchase or supply contract between users;
  • a bank, payment processor, money transfer service, escrow agent or financial institution;
  • a seller, importer, exporter, manufacturer or distributor of any goods listed;
  • a shipping, freight, customs or logistics provider;
  • an inspector or guarantor of product quality, quantity, specification, delivery or fitness for purpose.

Every trade contract is formed directly between the buyer and the seller. Verification badges show that we have checked certain identity documents — they are not a guarantee of a user’s honesty, solvency, product quality, or performance of any deal. You remain responsible for your own commercial due diligence.

2. Eligibility

To use MadeInPK you must:

  • be at least 18 years old;
  • be acting for a business or commercial purpose (this is not a consumer shopping platform);
  • have full legal capacity to enter into binding contracts;
  • not be barred from using the Platform under Pakistani law, and not appear on any applicable sanctions or terror-financing list;
  • not have been previously suspended or removed from MadeInPK.

If you register on behalf of a company, you confirm that you are authorised to bind that company, and “you” refers to both you and that company.

3. Account registration and security

  • You must provide accurate, current and complete information, and keep it updated.
  • One person or business may hold one account unless we approve otherwise in writing. Duplicate accounts created to evade limits, bans or fees may all be closed.
  • You are responsible for keeping your password and OTP codes confidential. Do not share them with anyone — MadeInPK staff will never ask for your password or an OTP.
  • You are responsible for all activity carried out through your account.
  • Notify us immediately at madeinpk00@gmail.com if you suspect unauthorised access.
  • You may not sell, rent, transfer or share your account with a third party.

4. Verification (CNIC, selfie, business and NTN)

  • To sell on MadeInPK, and to receive a verified badge, you must complete identity verification by submitting your CNIC number, CNIC photographs, a selfie/liveness video, and where applicable business premises photographs/video and your NTN certificate.
  • You confirm that every document you submit is genuine, unaltered, and belongs to you or to the business you are authorised to represent.
  • Submitting forged, borrowed, stolen or digitally edited identity documents is a serious offence. It will result in immediate and permanent account termination, forfeiture of any fees paid, and referral to law enforcement.
  • We may approve, reject, request more information, or re-verify an account at any time. Verification decisions are at our sole discretion.
  • A verified badge may be suspended or revoked if documents expire, if information changes, or if we receive credible reports of misconduct.
  • Verification documents are handled as described in our Privacy Policy — stored privately, never published, never sold.

5. Listings and seller obligations

If you list products, you undertake that:

  • you have the legal right to sell the goods, and they are legal to trade in Pakistan;
  • listing titles, descriptions, specifications, quantities, minimum order quantities, prices and units are accurate and not misleading;
  • photographs are of the actual product you are selling — stock, borrowed, watermarked or competitor images are not allowed;
  • you actually hold, or can reliably supply, the stock you advertise;
  • you honour prices and terms quoted to a buyer through the Platform;
  • you hold all licences, registrations and tax numbers required for your trade, and you are responsible for your own sales tax, income tax, withholding and invoicing obligations;
  • you keep listings current and mark sold or unavailable items promptly.

Listing limits: free (Basic) accounts may publish up to 3 active listings. Gold accounts may publish up to 15 active listings. Current limits and plan features are shown in the app and may be changed with prior notice.

We may edit, hide, block or remove any listing that breaches these Terms, is reported by users, or is unlawful — without prior notice where necessary for safety or legal compliance.

6. Prohibited items and prohibited conduct

6.1 Items you may not list

  • Weapons, ammunition, explosives, and their components
  • Narcotics, controlled substances, drug paraphernalia, alcohol, and tobacco where prohibited
  • Counterfeit goods, replicas, and anything infringing a trademark, copyright or design right
  • Smuggled, stolen, or customs-evading goods
  • Human body parts, human remains, endangered species, ivory, and protected wildlife products
  • Prescription medicines, unregistered pharmaceuticals, and unapproved medical devices
  • Pornographic, obscene, or blasphemous material
  • Currency, financial instruments, cryptocurrencies, lottery tickets, and gambling services
  • Hazardous chemicals and radioactive materials without lawful authorisation
  • Personal data lists, hacked accounts, and surveillance or hacking tools
  • Services or goods that require a licence you do not hold
  • Anything otherwise unlawful under the laws of Pakistan

6.2 Conduct you may not engage in

  • Impersonating another person, business or MadeInPK itself
  • Fraud, advance-fee scams, fake payment proofs, or non-delivery after payment
  • Price manipulation, fake orders, fake reviews, or rating manipulation
  • Deliberately circumventing platform fees after being introduced through MadeInPK
  • Harassment, threats, abuse, hate speech, or discriminatory content
  • Spam, bulk unsolicited messaging, or repeated off-topic promotion in chat
  • Sharing or requesting passwords, OTPs, or another person’s banking credentials
  • Scraping, crawling, reverse-engineering, decompiling, or automated access to the Platform
  • Uploading malware, or attempting to breach, overload or probe our systems
  • Using the Platform for money laundering, terror financing, or sanctions evasion

Breach of this Section may result in content removal, loss of verification, suspension, permanent ban, forfeiture of paid plan fees, and referral to the authorities.

7. User-generated content, moderation and reporting

  • You retain ownership of the listings, photographs, videos and messages you upload (“Your Content”).
  • You grant MadeInPK a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, display and distribute Your Content solely for the purpose of operating, promoting and improving the Platform. This licence ends when you delete the content or your account, except for copies retained in backups or required for legal records.
  • You confirm that you own or are licensed to use everything you upload, and that it does not infringe anyone’s rights.
  • Zero tolerance for objectionable content and abusive users. Content that is obscene, hateful, threatening, fraudulent or illegal is prohibited.
  • Reporting: every listing, chat and profile has a Report option, and you may also email madeinpk00@gmail.com. We review reports and act on objectionable content and abusive users within 24 hours, removing the content and ejecting the user where the report is upheld.
  • Blocking: you can block any user from contacting you, from their profile or from the chat screen.
  • We may proactively screen, filter or moderate content, but we are not obliged to monitor everything users post.

8. Orders, payments and IBAN transfers

  • An order is created when a buyer accepts a seller’s listing or negotiated offer. The resulting contract is between buyer and seller only.
  • MadeInPK does not process, hold or transmit any money. Payment is made by direct bank transfer to the counterparty’s IBAN, outside the Platform.
  • The buyer uploads a payment proof (transfer receipt) in the app. Sellers must independently confirm that funds have actually cleared in their own bank account before dispatching goods. A payment-proof image is not proof of cleared funds.
  • Always verify the IBAN and account title directly with your counterparty through the in-app chat before transferring. Never send money to an account whose title does not match the verified business name. MadeInPK is not liable for transfers made to an incorrect, changed or fraudulent account.
  • Prices are in Pakistani Rupees (PKR) unless stated otherwise. Taxes, duties, freight and bank charges are the users’ responsibility unless they agree otherwise.
  • Buyer and seller are responsible for their own invoicing, tax collection and tax filing.
  • Platform commission: [STATE COMMISSION — e.g. “MadeInPK currently charges no commission on trades” OR “a commission of X% of order value, invoiced to the seller”]. Any change to commission will be announced at least 30 days in advance.

9. Paid plans (Basic and Gold)

  • Basic is free and includes up to 3 active listings.
  • Gold is a paid plan that includes up to 15 active listings plus enhanced visibility and badges, for the fee and period shown in the app at the time of purchase.
  • Plan upgrades are paid by bank transfer with an uploaded payment proof, and are activated after our team verifies the payment (normally within [X] working hours).
  • Plan fees are non-refundable once the plan is activated, except where required by law, where we cancel your plan without cause, or as set out in Section 10.
  • Plans do not auto-renew unless the app states otherwise at purchase; you will be notified before expiry.
  • We may change plan pricing or features with at least 30 days’ notice. Changes do not affect a plan period already paid for.
  • If your account is terminated for breach of these Terms, any remaining plan period is forfeited.

10. Cancellations, refunds and disputes

10.1 Between buyer and seller

Cancellation, return, replacement and refund terms for goods are agreed between the buyer and the seller. Agree these in writing in the in-app chat before paying. MadeInPK does not hold funds and therefore cannot issue a refund of money paid directly between users.

10.2 Raising a dispute

  • Either party may open a dispute in the app within 7 days of the expected delivery date, giving order details, evidence and the outcome sought.
  • We will review the chat record, order record, payment proofs and any evidence submitted, and will normally issue a written finding within [7–14] working days.
  • Our role is facilitation and evidence-based mediation only. Our finding is not a court judgment and does not prevent either party from pursuing legal remedies.
  • We may record dispute outcomes on a user’s account, remove verification, suspend, or permanently ban a user found to have acted fraudulently.
  • Disputes about deals conducted off-platform cannot be mediated by us.

10.3 MadeInPK fees

Refunds of MadeInPK plan fees are handled as set out in Section 9. Where a refund is due, it is paid to the original bank account within [X] working days.

11. Reviews and ratings

  • Reviews must be based on a genuine transaction and reflect your honest experience.
  • Fake, incentivised, retaliatory or extortionate reviews are prohibited and will be removed.
  • We may remove reviews containing personal data, abuse, obscenity or unrelated content.
  • We do not edit review scores to favour any user, and paid plans do not alter your rating.

12. Intellectual property

  • The MadeInPK name, logo, brand, app, website, design system, source code, database structure and all related materials are owned by [LEGAL ENTITY NAME] and are protected by copyright and trademark law.
  • You receive a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Platform.
  • Infringement claims: if you believe content on MadeInPK infringes your intellectual property, email madeinpk00@gmail.com with proof of ownership, the exact URL or listing ID, and a statement of good-faith belief. We will investigate and remove infringing content, and we terminate repeat infringers.

13. Suspension and termination

By you: you may stop using the Platform and delete your account at any time via Settings → Account → Delete Account, or by emailing us. Open orders and unresolved disputes must be settled first.

By us: we may suspend or terminate your account, with notice where reasonably possible and immediately where necessary, if you breach these Terms, submit fraudulent documents or payment proofs, are credibly reported for fraud or abuse, create risk for other users or for MadeInPK, or are required to be removed by law.

On termination: your right to use the Platform ends immediately, your listings are removed, remaining paid plan periods are forfeited if termination was for breach, and Sections 12, 14, 15, 16, 17 and 18 survive.

14. Disclaimers

To the fullest extent permitted by law, the Platform is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that: the Platform will be uninterrupted, secure or error-free; any user, listing or document is authentic or accurate despite our verification checks; any transaction will be completed satisfactorily; or that goods will match their description, arrive on time, or be of any particular quality.

You transact with other users entirely at your own risk. Verify your counterparty independently, inspect goods where possible, keep written records, and prefer staged or partial payments.

15. Limitation of liability

To the fullest extent permitted by law:

  • MadeInPK is not liable for any loss arising out of a transaction between users, including non-delivery, defective or non-conforming goods, late delivery, non-payment, fraud by a counterparty, or money sent to a wrong or fraudulent bank account.
  • MadeInPK is not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profit, revenue, business, goodwill or data.
  • Our total aggregate liability to you for all claims in any 12-month period is limited to the greater of (a) the total fees you actually paid to MadeInPK in that period, or (b) PKR 10,000.
  • Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by our negligence.

16. Indemnity

You agree to indemnify and hold harmless MadeInPK, its owners, directors, employees and agents against any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your use of the Platform, your content, your transactions with other users, your breach of these Terms, or your violation of any law or third-party right.

17. Governing law and dispute resolution

  • These Terms are governed by the laws of the Islamic Republic of Pakistan.
  • Before starting legal proceedings, you agree to first contact us at madeinpk00@gmail.com and attempt to resolve the matter in good faith for 30 days.
  • If the dispute is not resolved, it shall be referred to arbitration by a sole arbitrator under the Arbitration Act, 1940, seated in [CITY], Pakistan, conducted in English or Urdu.
  • Subject to the above, the courts of [CITY], Pakistan have exclusive jurisdiction.

18. General

  • Changes: we may update these Terms. Material changes will be notified in the app or by email at least 14 days before they take effect, and continued use afterwards constitutes acceptance. The “Last updated” date always shows the current version.
  • Severability: if any provision is held invalid, the rest remains in force.
  • No waiver: failure to enforce a provision is not a waiver of it.
  • Assignment: you may not assign these Terms; we may assign them to a successor entity.
  • Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and MadeInPK regarding the Platform.
  • Language: these Terms are published in English. Any Urdu translation is provided for convenience; in case of conflict, the English version prevails.
  • Force majeure: we are not liable for failures caused by events beyond our reasonable control, including internet or power outages, government action, natural disasters or civil unrest.

19. App store terms

  • Your use of the app is also subject to the terms of the store you downloaded it from (Apple App Store or Google Play).
  • Apple: this agreement is between you and MadeInPK only — not with Apple. Apple has no obligation to provide support or maintenance for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. MadeInPK, not Apple, is responsible for product liability claims, claims that the app fails to meet legal requirements, and third-party intellectual property claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You confirm that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and are not on any US Government restricted-party list.
